RIDE check stop nets impaired driving charges for Tay Township man

Driver also faces charges of operating a vehicle while under suspension, and failure to wear a seatbelt

MIDLAND - On Sunday, April 22, 2018 at 2:09 a.m. officers from the Southern Georgian Bay Detachment of the Ontario Provincial Police (OPP) while operating a R.I.D.E. check stop on King Street happened to check the sobriety of the driver of a BMW which approached the stop location.

An officer spoke to the male driver and entered into a drinking and driving investigation which continued back at Southern Georgian Bay Detachment.

As a result of the investigation the male driver Allen Deschamps 28 years old of Tay Township has been charged with the following offences;

  • Driving While Ability Impaired- motor vehicle (Alcohol) contrary to section 253(1)(a) of the Criminal Code of Canada
  • Driving with More than 80 mgs. of Alcohol in Blood contrary to section 253(1)(b) of the Criminal Code of Canada
  • Dangerous Operation of Motor Vehicle contrary to section 249(1)(a) of the Criminal Code of Canada
  • Driving while under suspension contrary to section 53 (1) of the HIghway Traffic Act of Ontario
  • Drive motor vehicle - no licence contrary to section 32(1) of the HIghway Traffic Act of Ontario
  • Driver - fail to properly wear seat belt contrary to section 106(2) of the HIghway Traffic Act of Ontario

His vehicle was towed from the scene and impounded for seven days and further his driver's license is suspended for 90 Days under the Administrative Driver's License Suspension (ADLS) and he was released on a recognizance to appear before the Ontario Court of Justice in Midland on May 3, 2018.
